Conditions of participation with data protection notice: ‘Prize draw with Ben Beyer (DJ David Puentez)’ on Instagram by sieger design GmbH & Co. KG

1. Organiser

We, sieger design GmbH & Co. KG, with headquarters at Schloss Harkotten, 48336 Sassenberg in Germany, are the organiser of and party responsible for the ‘Prize draw Ben Beyer (DJ David Puentez)’. The influencer Ben Beyer (DJ David Puentez) is acting as our agent by announcing the competition on his official Instagram profile @davidpuentez and providing an opportunity to enter the competition.

2. Eligibility

Those eligible to participate are people aged at least 18 years whose permanent residence is in the European Union and who participate in the competition in a timely manner and in line with conditions. Our employees and their dependants, employees of Porzellanmanufaktur FÜRSTENBERG GmbH and employees and relatives of Ben Beyer as our agent are excluded from participation.

3. Participation

Participation is free of charge and is not conditional on a purchase or conclusion of any contract with us. Prerequisites for participation are having an Instagram profile and the timely fulfilment of the following conditions:

1. Like the post on the prize draw in the @davidpuentez feed

2. Write a comment tagging at least two additional contacts

3. Follow the official Instagram account of SIEGER @sieger.germany

4. Follow the official Instagram account of Ben Beyer (DJ David Puentez) (@davidpuentez)

Participation is possible from the moment the campaign is announced by Ben Beyer (DJ David Puentez) on Instagram on Saturday, 4 June 2022 until Thursday, 9 June 2022 at 11.59pm (UTC+2).

4. Exclusion of participants

We reserve the right to disqualify any participant in the event of a breach of participation eligibility or the conditions of participation, as well as any other form of manipulation. This also applies to the suspicion of a breach or of manipulation. Participation via automatically generated mass submissions or competition agencies is expressly excluded and will not be considered when determining the winners.

5. Prizes, winners and winner notification

3 x 2 Grand Cru Gold tumblers from SIEGER by FÜRSTENBERG will be raffled (Black Curl decor). Shipping shall only take place within the EU.

The winner will be drawn at random following the participation deadline. A cash alternative will not be paid in place of the prizes. Following completion of the draw, the winner will be contacted by direct message (Instagram) from the SIEGER account @sieger.germany and informed of their win, as well as being asked for his/her postal address (name, postal address in the EU). If this is not provided within two weeks, we reserve the right to draw a new winner and to send the prize to them. The prizes will then be posted to the address provided within the EU.

6. Disruption to, suspension of and premature termination of the competition

We reserve the right to terminate the competition with future effect at any time. We are not responsible for any technical disruption that may influence the smooth operation of the competition. In the event that these difficulties are the result of force majeure or external circumstances outside of our influence, we reserve the right to suspend the competition completely or temporarily. Furthermore, we may modify the competition insofar as this is required to ensure proper functioning.

7. Exclusion of liability for user contributions

Participants undertake to behave in a legally compliant fashion. Contributions may not include defamation or false claims, nor breach competition, trademark or copyright regulations. Nevertheless, should third parties assert claims due to a breach of their rights, participants indemnify us against all claims. By participating in the competition, each participant assumes personal responsibility for any legal violation made by them.

8. Data protection

We use participant data (name of the Instagram profile, title, first name, surname, address) in order to conduct the prize draw (cf. Art. 6 paragraph 1b DSGVO). Prizes cannot be delivered to participants without these data.

With your participation, you expressly consent to our contacting you via Instagram direct message. You may revoke your consent at any time, however in this case participation in the competition will no longer be possible. Please note that a user’s data may be processed outside of the European Union. This may result in risk for users because e.g. enforcement of user rights may be impeded.

Correspondence and contact data will be stored exclusively on Instagram. Two weeks following the prize draw, we will delete the personal address data and the message thread associated with the prize draw. Data that are visible on Instagram or may be noted by somebody on our open profile will remain visible. Data may be deleted by the originator at any time insofar as Instagram permits this.

Participants have the right to revocation, access, rectification, cancellation, limitation or opposition regarding the processing of their data, as well as data portability. Furthermore, complaints may be lodged with the supervisory authority at any time.

9. Final provisions

Legal recourse is excluded with regard to the drawing of winners and any evaluation of the competition contributions submitted.

This competition is not connected to Instagram and is not supported, organised or sponsored by Instagram in any way. We as the organiser are the recipient of the data provided by the Instagram user. Participants release Instagram from any liability or claim resulting in association with the draw. Any questions, comments or complaints regarding the competition should be directed to us and not to Instagram.
